Man accused of having sex while driving drunk with baby in car gets 2-year prison sentence
TACOMA, Wash. - A Puyallup man who was driving drunk and having sex while a 3-month-old baby was in the backseat, then crashed into a tree was sentenced to just over two years in jail Tuesday.
Michael Tonkin had pleaded guilty to vehicular assault and was sentenced to 24 months plus one day in jail, according to the Pierce County prosecutor's office.
Tonkin and his female passenger were drunk and having sex while Tonkin was driving along SR-7 near Eatonville on Nov. 22 when they crashed. Witnesses reported seeing both emerge from the car naked. Officials said they could have hit someone head-on or they could have gone over the edge of the steep canyon, had it not been for the big tree they hit.
Tonkin, 22, suffered an injured wrist. The 22-year-old woman in the car was not wearing a seat belt and suffered a broken pelvis and had trouble breathing. Her 3-month baby girl in the backseat was unharmed in a car seat.
Tonkin had three prior convictions for DUI.
